DMCA Copyright Policy

EduCafe is operated by Triples Global LLC, a California limited liability company. EduCafe respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement. This policy describes how to submit a takedown notice, how to file a counter-notification if your content was removed in error, and the policy under which we terminate repeat infringers.

Designated agent

Notices of claimed infringement must be sent to our designated agent:

Only properly submitted notices sent to the designated agent will be actioned under this policy. Notices sent elsewhere may not receive a timely response.

Filing a takedown notice

If you believe that material hosted on EduCafe infringes a copyright you own or are authorized to represent, send a written notice to our designated agent that includes all six elements required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the material that is claimed to be infringing and that is to be removed, with enough information to let us locate it (for example, the course URL or module title).
  4. Information reasonably sufficient to let us contact you, such as your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. If you are unsure whether material infringes your copyright, you may wish to consult an attorney before submitting a notice.

Our response

Upon receiving a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the identified material, and we will make a reasonable attempt to notify the user who posted it. We may also note the action against the account under our repeat-infringer policy.

Counter-notification

If you believe your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which EduCafe may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notification, we will forward it to the party who submitted the original takedown notice. We may restore the removed material in 10 to 14 business days unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the allegedly infringing activity.

Repeat-infringer policy

In accordance with 17 U.S.C. § 512(i), EduCafe will, in appropriate circumstances, suspend or terminate the accounts of users who are determined to be repeat infringers. We assess infringement on a case-by-case basis. Factors we may consider include the number and nature of valid takedown notices received against an account, whether the user has filed successful counter-notifications, and any pattern of conduct. Termination may include removal of the user’s content and a bar on creating new accounts.

Misuse

Submitting a false takedown notice or a false counter-notification may expose you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f). Please make sure your claims are accurate before submitting.

For content concerns that are not copyright-related (for example, spam, misleading material, or content that violates our Terms), use the “Report this course” option on the course page, or contact us directly.

Changes

We may update this policy from time to time. Material changes will be reflected by updating the date at the top of this page.
